These Terms of use govern the rules and conditions under which users may access and utilize the DynaForm service. By using the service, users agree to comply with these Terms and acknowledge that any violation may result in restricted access or termination of use
2. Scope of services
DynaForm provides tools for creating online forms, collecting data, and automatically transferring it to specified external systems (CRM, ERP, messengers, etc.) via API. The service is intended for lawful use only and may not be exploited for activities that violate applicable legislation or infringe upon the rights of third parties
3. User responsibilities
Users are fully responsible for the accuracy and legality of the data they collect through forms, as well as for the content placed in the forms. They agree not to use the service to distribute unlawful, offensive, or harmful content. Users must ensure the security of their credentials and refrain from actions that could compromise the service's functionality or the security of other users' data
4. Intellectual property
All software, design, interface, and content of the DynaForm service are the intellectual property of SQILSOFT. Users are granted a limited, non-exclusive, non-transferable right to use the service for its intended purpose during the term of the agreement. Any copying, reproduction, modification, distribution, or creation of derivative works based on the service's components without the prior written consent of the copyright holder is strictly prohibited
5. Data processing and privacy
Use of the service involves the processing of personal data in accordance with the Privacy Policy. By creating forms and collecting data through them, the User acts as the data controller and assumes full responsibility for compliance with personal data protection legislation regarding such data. SQILSOFT acts as a data processor performing technical functions and undertakes to ensure the security of data on its infrastructure
6. Service availability
We strive to ensure a high level of service availability but do not guarantee absolutely uninterrupted or error-free operation. Maintenance, updates, or unforeseen failures may temporarily limit access. SQILSOFT is not liable for any damages resulting from such planned or unplanned interruptions, unless they are due to gross negligence or willful misconduct
7. Third-party integrations
The DynaForm service is designed for integration with external systems of the user's choice. The user independently configures the connection and data transfer. SQILSOFT is not responsible for the functionality, security, availability, or privacy policies of any third-party services, nor for the correctness of data transmission caused by errors in the settings provided by the user
8. Limitation of liability
Except as expressly provided by the applicable law of the Republic of Belarus, SQILSOFT shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the DynaForm service, including, but not limited to, loss of data, lost profits, business interruption, or reputational harm, even if SQILSOFT has been advised of the possibility of such damages
9. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Belarus. All disputes, controversies, or claims arising out of or in connection with these Terms or the use of the service shall be resolved in the courts of the Republic of Belarus at the location of the defendant
10. Changes to Terms
SQILSOFT reserves the right to unilaterally modify these Terms. The new version of the Terms becomes effective from the moment of its publication on the service's website, unless otherwise stated in the text of the changes. Continued use of the service after changes are made constitutes the user's acceptance of the new version of the Terms
