1. General Provisions
These Terms of Use govern the rules and procedure for users’ access to and use of the DynaAssistant service. Use of the service implies the user’s full and unconditional consent to these Terms. Violation of the established rules may result in restriction or termination of access to the service.
2. User Obligations
The user bears full responsibility for the data, content and business processes created and processed using the DynaAssistant service. The user undertakes to:
— use the service exclusively for lawful purposes;
— not post or process illegal, malicious or content violating third party rights;
— ensure the security of their account credentials and prevent unauthorized access;
— not take actions that could disrupt the service’s functionality or the data security of other users.
3. Intellectual Property
All software, architecture, interfaces, design and other elements of the DynaAssistant service are the intellectual property of SQILSOFT company. The user is granted a limited, non-exclusive, non-transferable right to use the service solely for its functional purpose for the duration of the contractual relationship. Any copying, modification, distribution or other use of the service components without the written consent of the copyright holder is prohibited.
4. Data Processing and Confidentiality
Use of the DynaAssistant service involves the processing of personal data in accordance with the Privacy Policy. A user who uses the service to process third-party data acts as a data operator and independently bears responsibility for compliance with personal data protection legislation. SQILSOFT company acts as a data processor and performs exclusively technical and infrastructural functions, ensuring data protection within the scope of its responsibility.
5. Service Availability
We strive to ensure stable and uninterrupted operation of the DynaAssistant service, however we do not guarantee its continuous and error-free availability. Scheduled maintenance, updates or unforeseen failures may temporarily restrict access. SQILSOFT is not liable for losses arising from such interruptions, except in cases of intent or gross negligence.
6. Integration with Third-Party Services
The DynaAssistant service supports integration with external systems at the user’s choice. Configuration and correctness of such integrations are carried out by the user independently. SQILSOFT is not responsible for the operation, security, availability and privacy policies of third-party services, nor for the consequences of errors in integration settings.
7. Limitation of Liability
Except for cases expressly provided for by the legislation of the Republic of Belarus, SQILSOFT is not liable for any direct or indirect losses arising from the use or inability to use the DynaAssistant service, including data loss, lost profits, suspension of business processes or reputational damage.
8. Applicable Law and Jurisdiction
These Terms are governed and interpreted in accordance with the legislation of the Republic of Belarus. All disputes arising from these Terms or in connection with the use of the DynaAssistant service shall be resolved in the courts of the Republic of Belarus at the location of the defendant.
9. Changes to Terms
SQILSOFT company reserves the right to unilaterally change these Terms. The new version of the Terms comes into force from the moment it is published on the service website, unless otherwise specified in the text of the changes. Continued use of the service after changes are made implies the user’s consent to the new version of the Terms.
